Australian Brand search The next step after a Brand audit is to protect the Trademark and determine if the Trademark is eligible and registerable.
- We searched the Australian Register to determine if there are any Trademark conflicts with the proposed Trademark application and to see if the Trademark could be registered by our Trademark Attorneys in the Gold Coast or other States. It also provides the company owner with an insight into the possibility of infringement of Registered Trademarks earlier on.
- This includes searching for Brands that look and sound similar and searching for prefixes and suffixes. Also, make sure that the application does not contain any prohibited signs. This can prevent Trademark Registration.

Australian Brand presentation
Australian Trademarks can be registered for one or more than 45 different classes (categories) of goods and services.

Trademark Examination by the Trademark Office
Once the application is submitted, the Australian Trademark Office will “search and assess” the Trademark.
- This means that our office will receive all communications about your Brand application, and send us details of the required actions.
- In case of problems, the Australian Trademark Office will provide a written report objecting. However, if we completed the search on your behalf, you should have been aware of potential conflicts before applying.
Trademark registration
Upon completing the examination, the Australian Trademark Office will hopefully accept the Trademark application. The details will be published in the Official Australian Trademark Journal, allowing third parties to challenge.
- You can register your Trademark for the first ten years after acceptance, and you will receive a formal certificate of registration.
- Australian Trademarks Registration protects the trademark rights in Australia, and does not need to be registered in individual States of Australia. The entire Trademark process in Australia takes at least seven months, during which the application runs smoothly if you are represented by our Trademark Attorneys in Melbourne, or other states. A commercial lawyer must assist in the registration, as any objection can delay the process.
